Issues to Consider

Think about your children's future. Consider their needs over the next five, ten, or fifteen years. What activities do you want them to be involved in? Are there music, sports, or other extra curricular activities they will want to participate in? Will your child be celebrating a Bar Mitzvah or Bat Mitzvah? Does your child have special needs? What are your educational goals for your child? Who is responsible for your children's health insurance?

The judge will not automatically consider all of these issues. You are much more likely to come to an agreement that is tailored to your children's unique needs through negotiations, mediation, or the collaborative law process than by relying on a judge who does not know you or your family to make these important decisions.

It is critical to address these issues from the start, as it can be difficult to modify child support later on. Child support modification is based upon unforeseen circumstances. In other words, if you know your child has special needs, which are not addressed now, the court may not address them in the future.
